Acceptance of Terms
By accessing or using the Tile & Mosaic Depot website (tileandmosaicdepot.com) or by placing an order through our website, phone, or any other channel, you agree to be bound by these Store Policy terms and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this website.
These terms constitute the entire agreement between you and Pacific Trade and Design Corp (dba Tile & Mosaic Depot) with respect to the use of this website and the purchase of products. These terms supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
By placing an order, you confirm that: You have read and understood our natural stone variation policy, our shipping and return policies, and our installation disclaimer. You accept that variations in natural stone are not defects and not grounds for return, and that once tile is installed it is considered accepted.
Products & Natural Stone Policy
Natural Variation
Natural stone — including marble, travertine, limestone, onyx, basalt, quartzite, and granite — is a geological material formed over millions of years. Every piece is unique. Shade, color, veining, texture, and pattern vary naturally between individual tiles, between production lots, and between quarry batches. This variation is an inherent characteristic of natural stone and is not a manufacturing defect.
Tile & Mosaic Depot makes every reasonable effort to represent our products accurately through photography. However, variations in monitor calibration, photography lighting, and natural stone characteristics mean that product appearance on screen may differ from the actual material received. This is not grounds for return or refund.
Shade Variation Scale (V-Rating)
All natural stone products inherently carry a V3 or V4 shade variation rating on the industry standard scale. This means you should expect meaningful differences in shade, tone, and pattern between individual tiles within the same order. Porcelain products typically carry V1–V2 ratings and exhibit less variation.
Natural Stone Characteristics
- Travertine pits and voids: Travertine naturally contains pits, voids, and dry seams — formed during its geological creation. These are not defects. They may be filled or unfilled. Filling may work loose over time as part of normal maintenance.
- Veining: Marble and onyx veining varies dramatically between pieces. Pattern direction, intensity, and color within the same product name can differ significantly.
- Porosity: All natural stone is porous to varying degrees and requires sealing before and after installation. Failure to seal properly may result in staining.
- Fossil inclusions: Some limestone products naturally contain fossil inclusions — these are characteristic of the material and not defects.
- Shade between lots: Natural stone from different quarry lots or production batches may exhibit color differences. Always order full project quantity in a single order.
Important: By ordering natural stone products, you acknowledge that you have read and understood the Tile & Mosaic Depot Shade & Color Variation Guide and that variation is an inherent, accepted characteristic of natural stone, not a defect or grounds for any claim.
Product Availability
All products are sold subject to availability. While we maintain substantial in-stock inventory, we reserve the right to cancel or modify orders in the event of inventory shortfalls or pricing errors. We will notify you promptly and offer a full refund or alternative if we cannot fulfill your order as placed.
Quantity Estimates
Our tile calculator and any quantity recommendations provided by our team are estimates only. Tile & Mosaic Depot is not responsible for under-ordering or over-ordering resulting from inaccurate measurements or failure to include adequate waste factor. Customers are responsible for verifying quantities with their installer before placing an order. We recommend ordering 10–15% extra material above measured square footage.
Samples Policy
We strongly recommend and actively encourage customers to order samples before placing a full order, particularly for natural stone products. Samples are available free of charge on all products.
- Samples are representative swatches of the product. They convey the general character, color range, and finish of the material but cannot guarantee the exact appearance of each tile in a full order, as natural stone varies between pieces.
- Samples are provided as a courtesy and ordering a sample does not constitute a purchase commitment on either side.
- After evaluating a sample and placing a full order, the customer accepts the inherent variation of natural stone as described in Section 2 of this policy.
- Sample availability is subject to stock. Tile & Mosaic Depot reserves the right to discontinue free sample availability at any time.
Orders & Pricing
Order Acceptance
Your order constitutes an offer to purchase products at the stated price. Tile & Mosaic Depot reserves the right to accept or reject any order at its discretion. An order is accepted when we send an order confirmation email and process payment.
Pricing
All prices are listed in U.S. dollars and are subject to change without notice. Prices listed on the website do not include applicable taxes or shipping costs, which are calculated at checkout. We reserve the right to correct pricing errors at any time, including after an order has been placed.

Promotions cannot be combined unless explicitly stated. Tile & Mosaic Depot reserves the right to modify or discontinue any promotion at any time without notice.
Order Changes & Cancellations
Order changes or cancellations must be requested before the order ships. Contact us immediately at 855-797-8453 or sales@tileandmosaicdepot.com if you need to modify or cancel an order. Once an order has shipped, it cannot be cancelled and must proceed through the return process where applicable.
Shipping & Delivery
Delivery Times
Most in-stock orders ship within 1–3 business days of order confirmation. Delivery times vary by destination and carrier. Tile & Mosaic Depot is not responsible for delays caused by carriers, weather, or circumstances beyond our control.
Freight Deliveries
Large orders shipped by freight carrier require a delivery appointment scheduled by the carrier. You are responsible for ensuring someone is available to receive and inspect the delivery. Failure to be available for a scheduled freight delivery may result in redelivery fees charged to the customer.
Receiving Your Order — Critical
Inspect all shipments before signing. You must inspect your order at the time of delivery before signing the carrier's delivery receipt. If any damage is visible — to the packaging or the tiles — you must: (1) note the damage specifically on the carrier's delivery receipt before signing, (2) photograph all damage immediately, and (3) contact us within 48 hours. Signing "received in good condition" for a visibly damaged shipment waives your right to claim freight damage.
Risk of Loss
Risk of loss and title to products passes to the customer upon delivery to the shipping carrier. Tile & Mosaic Depot is not liable for loss or damage occurring after the product has been delivered to the carrier.
Returns & Exchanges
Return Eligibility
Returns are accepted on eligible products within 30 days of delivery, subject to the following conditions:
- Product must be uninspected, uninstalled, and in its original packaging
- Return must be initiated by contacting us within 30 days of delivery date
- A return authorization must be obtained before shipping any product back
- Customer is responsible for return shipping costs unless the return is due to our error or a product defect
Non-Returnable Items
- Installed tile: Any tile that has been installed is considered accepted and cannot be returned under any circumstances. This policy is consistent with industry standards established by the Tile Council of North America (TCNA) and the National Tile Contractors Association (NTCA).
- Natural stone variation: Shade variation, color variation, veining differences, and tonal shifts in natural stone products are not defects and do not constitute grounds for return.
- Custom or special orders: Products ordered specifically for a customer (non-stock items) are not returnable.
- Clearance items: Products sold as clearance or final sale are non-returnable.
Damaged or Defective Products
If your order arrives damaged or contains genuinely defective products (as distinct from natural stone variation), contact us within 48 hours of delivery with photographs of the damage. We will work with you to arrange replacement of damaged or defective items at no cost to you.
Inspection Before Installation
All products must be fully inspected before installation begins. Identifying and setting aside damaged or unsatisfactory pieces before installation is the customer's responsibility. Claims for defects cannot be honored after installation has begun. Use questionable pieces for cuts and border areas.
Installation & Use
Tile & Mosaic Depot does not provide installation services. All products must be installed by a qualified professional tile installer in accordance with applicable building codes and TCNA (Tile Council of North America) guidelines.
- Tile & Mosaic Depot accepts no liability for improper installation, use, or maintenance of its products.
- All natural stone products must be sealed with an appropriate penetrating stone sealer before and after installation. Failure to seal properly may result in staining, damage, or deterioration that is not covered by any warranty or return policy.
- Customers are solely responsible for determining that selected products are suitable for their intended application, including but not limited to slip resistance ratings (DCOF), frost resistance, load-bearing capacity, and chemical compatibility.
- Tile & Mosaic Depot disclaims all liability for any damages, losses, or claims arising from installation activities, including but not limited to exposure to crystalline silica dust. See our California Prop 65 Notice for required safety disclosures.
- After product installation, all liability for the installed tile transfers to the customer and/or their installer. Tile & Mosaic Depot disclaims any liability for the performance of installed products.
Limitation of Liability & Disclaimer of Warranties
Disclaimer of warranties: The products and information on this website are provided "as is" without warranty of any kind, express or implied. Tile & Mosaic Depot disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability: In no event shall Pacific Trade and Design Corp (dba Tile & Mosaic Depot), its officers, directors, employees, agents, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, loss of data, or business interruption — arising from the use of or inability to use our products or website, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
Maximum liability: Our total liability to you for any claim arising from your use of this website or purchase of products shall not exceed the total amount you paid for the specific product giving rise to the claim.
Natural stone disclaimer: Tile & Mosaic Depot makes no representation that its natural stone products are free from inherent variation, and such variation is explicitly excluded from any warranty or guarantee. Product photography is illustrative and may not exactly represent the material received.
Indemnification
You agree to indemnify, defend, and hold harmless Tile & Mosaic Depot, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the website or products; (b) your violation of these terms; (c) your violation of any third-party rights; or (d) improper installation or use of products purchased from us.
Intellectual Property
All content on this website — including but not limited to text, photography, graphics, logos, product descriptions, design elements, and compilation of content — is the property of Pacific Trade and Design Corp (dba Tile & Mosaic Depot) or its content suppliers and is protected by applicable copyright, trademark, and intellectual property laws.
- You may view and print content from this website for personal, non-commercial use only.
- You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from this website without our prior written permission.
- Product photography is proprietary. Unauthorized use of our product images is prohibited and may constitute copyright infringement.

Governing Law & Dispute Resolution
These terms and conditions, and any dispute arising from your use of this website or purchase of products, shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any legal action or proceeding relating to your access to or use of the Tile & Mosaic Depot website, or any products purchased through our website, shall be instituted in a state or federal court located in California. You and Tile & Mosaic Depot agree to submit to the personal jurisdiction of, and that venue is proper in, such courts.
Before initiating legal action, both parties agree to attempt to resolve any dispute informally by contacting us at sales@tileandmosaicdepot.com. We will attempt to resolve the dispute within 30 days.
Changes to This Policy
Tile & Mosaic Depot reserves the right to modify this Store Policy at any time without prior notice. Changes are effective immediately upon posting to the website. Your continued use of the website after any changes constitutes your acceptance of the modified terms.
We encourage you to review this page periodically for any updates. The "Last updated" date at the top of this page indicates when the policy was last revised.
Website Use & Conduct
By using this website, you agree not to:
