This page contains required legal disclosures for customers in California and all states. Tile & Mosaic Depot is committed to full compliance with California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65) and all applicable federal and state consumer protection laws.
WARNING: Some products sold by Tile & Mosaic Depot can expose you to chemicals including crystalline silica (airborne particles from cutting or grinding), which is known to the State of California to cause cancer, and lead and other chemicals, which are known to the State of California to cause birth defects or other reproductive harm. This warning applies to natural stone and ceramic tile products when cut, ground, or otherwise processed. About Proposition 65
California's Proposition 65, officially known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide clear and reasonable warnings before knowingly exposing anyone to chemicals listed by the State of California as known to cause cancer, birth defects, or other reproductive harm.
The Proposition 65 list is maintained by the California Office of Environmental Health Hazard Assessment (OEHHA) and currently includes approximately 900 chemicals. The list is updated at least annually. A complete and current version of the list is available at oehha.ca.gov.
Important clarification: A Proposition 65 warning does not mean a product is unsafe or in violation of any product safety standard. The California government has stated that a Prop 65 warning "is not the same as a regulatory decision that a product is 'safe' or 'unsafe.'" The warning is a notification right — informing consumers that a product may contain a listed chemical above a threshold level.
Products Subject to This Warning
The following categories of products sold by Tile & Mosaic Depot may be subject to Proposition 65 warnings:
- Natural stone tile and slabs (marble, travertine, limestone, onyx, basalt, quartzite, granite) — may contain naturally occurring crystalline silica, which can become airborne during cutting, grinding, or dry-sweeping of dust.
- Ceramic and porcelain tile — may contain crystalline silica and other compounds that can be released as airborne particles during installation, cutting, or grinding.
- Glass mosaic tile — may contain lead compounds used in colorants or glazes.
- Grout, setting materials, and adhesives (where sold) — may contain crystalline silica, Portland cement, and other listed chemicals.
The primary exposure risk associated with these products occurs during installation activities — specifically wet or dry cutting, grinding, drilling, or dry-sweeping of tile dust — and not from ordinary use of properly installed tile.
Safe Handling & Installation Guidance
Tile & Mosaic Depot strongly recommends the following precautions during installation:
- Always use wet-cutting methods when cutting natural stone or ceramic tile to suppress airborne dust.
- Wear an NIOSH-approved respirator (N95 or higher) when cutting, grinding, or sanding tile.
- Use protective eyewear and gloves during all cutting and installation activities.
- Ensure adequate ventilation in the work area during installation.
- Avoid dry sweeping tile dust — use wet methods or a HEPA vacuum to clean up.
- Keep children and pregnant women out of the installation area until work is complete and the area has been cleaned.
- Follow all manufacturer and installer guidelines for the specific product being installed.
Note on installed tile: Once tile is properly installed and sealed, the risk of chemical exposure from normal use is minimal. The warnings above apply primarily to the installation process, not to day-to-day contact with finished tile surfaces.

General Terms of Sale & Consumer Notices
By purchasing from Tile & Mosaic Depot, customers acknowledge and agree to the following:
- Natural stone variation: All natural stone products are geological materials. Color, veining, texture, and shading vary between pieces, lots, and quarry batches. Tile & Mosaic Depot makes reasonable efforts to accurately represent products through photography; however, variations are inherent to natural stone and do not constitute defects.
- Color accuracy: Product colors as displayed on screen may differ from actual materials due to monitor calibration, photography conditions, and natural variation. We strongly recommend ordering samples before placing a full order.
- Quantity estimates: Tile & Mosaic Depot provides tile calculators as a convenience. All quantity estimates should be verified by a qualified installer. We recommend ordering 10–15% overage for cuts, waste, and future repairs.
- Installation: Tile & Mosaic Depot does not provide installation services. Installation should be performed by a qualified tile installer in accordance with applicable building codes and Tile Council of North America (TCNA) guidelines.
- Suitability: Customers are responsible for determining that selected products are suitable for their intended application — including but not limited to slip resistance ratings, frost resistance, load-bearing capacity, and chemical compatibility.

Governing Law & Jurisdiction
These terms and all disputes arising from purchases made through Tile & Mosaic Depot shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
Any legal action or proceeding relating to your access to, or use of, the Tile & Mosaic Depot website or products shall be instituted in a state or federal court in California. You and Tile & Mosaic Depot agree to submit to the personal jurisdiction of, and agree that venue is proper in, the courts located in California.
